Will Writing

If someone passes away without leaving a Last Will and Testament, the law will determine who inherits what they own. In legal jargon, this is described as ‘dying intestate’, where any money, property and personal possessions belonging to the deceased will be distributed in accordance with the rules of intestacy, rather than in accordance with their final wishes.

In some cases, if someone has died without making a Will, or having a properly executed Will in place, the rules of intestacy may mean loved ones, even those who have lived with or were otherwise financially dependent on the deceased, will not be entitled to inherit a penny. Equally, if someone dies without having updated an existing Will following a change of circumstances — for example, having got divorced, remarried or had children — this may mean that their estate is distributed in a way that doesn’t reflect their most recent wishes.

Ensuring that a current Will is in place, one that’s legally compliant and clearly drafted, can help to protect loved ones from future financial uncertainty. It can also ensure that the testator’s estate is dealt with in the manner of their choosing and by those that they trust, where they can appoint who they’d like to act as executors. Further, along with clever tax planning, a Will can be used to help reduce any liability to Inheritance Tax, not to mention make provision for the care of any children under 18 by way of a guardianship clause.
