Probate Solicitors in Nelson, Barrowford and Burnley
At Farnworth Rose, we provide specialist advice and support to bereaved families the process of administrating a loved one’s estate.
Probate is the term which is commonly used when applying for the right to administer the estate of a person who has passed away. This is known as a Grant of Representation or letters of administration, a legal document which confirms the Executor or Administrator has the authority to deal with the estate.
The person or persons named as an Executor in a Will must handle the estate by paying any taxes and bills and distributing any money or property to those who are entitled to it.
If you have been appointed the Executor of somebody’s Will or are required to act as the Administrator of an estate, our experts can help remove the stress and worry of dealing with organisations such as banks, the Courts and the Inland Revenue.
We can also help you access up to 60% of your inheritance upfront, for more information on this please click here.

Cost of applying for the Grant, collecting and distributing the assets
Dependent on the size of an estate, we anticipate that the process will take between 7.5 and 10 hours at £201.00 per hour plus VAT (£241.20 including VAT). The total costs for a smaller estate are estimated at £1500 and £2000 plus VAT (£1800 – £2400 including VAT).
The exact cost will depend on the individual circumstances of your matter. For example, if there is one beneficiary and no property, costs will be at the lower end of the range. Where there are multiple beneficiaries, a property and multiple bank accounts, costs will be at the higher end.
The team at Farnworth Rose will explain the process and, if instructed, deal with the full process for you. The above guidelines are for estates where:
- There is a valid Will
- There is no more than one property
- There are no more than 3 bank or building society accounts
- There are no other intangible assets
- There are no disputes between beneficiaries on division of assets. Where disputes do arise, it is likely to lead to an increase in costs
- There is no inheritance tax payable and the executors do not need to submit a full account to HMRC
- There are no claims made against the estate.
Disbursements included in this fee:
- Court application fee for the Grant of Representation is £155 plus £1.50 per sealed copy
- Bankruptcy searches of beneficiaries are £2 each
Disbursements are the costs related to your matter that are payable to third parties such as court fees.
The team at Farnworth Rose will deal with the payment of the disbursements on your behalf to minimise delays and ensure a smoother process.
What are the potential additional costs?
- If there is no Will or the estate consist of any shareholdings (stocks and bonds), there is likely to be additional costs. These can vary significantly depending on the estate and how it is to be dealt with. Your solicitor can provide a more accurate quote once they have more information
- If any additional copies of the grant are required, they will cost £1.50
- Dealing with the sale or transfer of any property in the estate is not included.
